ENFORCEMENT
An enforcement act involves a legal procedure that allows a natural person or a company to obtain, in a forced manner, the execution of the legal decisions by which their rights are recognized.
For example, a party named – the debtor, does not fulfill its obligation to the party named – the creditor, the latter may initiate legal enforcement actions against the debtor. To achieve this objective, the creditor will address a court executor.
Thus, the parties involved in an enforcement dossier are:
The creditor – the natural or legal person to whom is owed money or benefits.
The debtor – the natural or legal person who owes money or benefits to the creditor.
In order to initiate an enforcement procedure the creditor has to submit to the court executor an enforcement request against the debtor.
